I have worked extensively on the local, state and federal policy, legal and agency decision-making aspects of the Comprehensive Everglades Restoration Plan, cutting edge "carrying capacity" land use planning in the Florida Keys, climate and sea level rise sustainability issues in south Florida and a wide variety of environmental and land use issues throughout Florida. My specific practice areas include:
Land Use Advocacy & Litigation
I work with clients to analyze proposals for comprehensive plan amendments, land use changes and development approvals at the city and county level, gather, prepare and present effective information and arguments in opposition or for revisions to inappropriate proposals, and determine and implement strategies to enforce client’s legal rights.
I am available to represent local governments to defend legal challenges to their comprehensive planning, land development regulation, or development order decisions that are challenged by landowners or developers for alleged violations of constitutional or statutory rights.
Comprehensive Planning and Land Development Codes
I am available to work with local governments to prepare and defend amendments to their comprehensive plans and land development codes to respond to changes in state law or local needs.
Florida Environmental Law
I work with clients to analyze proposals for Environmental Resource (wetland), Consumptive Water Use, Sovereign Submerged Land, Coastal Construction, and other state permits, gather, prepare and present effective information and arguments in opposition or for revisions to inappropriate proposals, and implement strategies to enforce client’s legal rights.
Florida Utilities Practice
I represent clients before Florida’s Public Service Commission in support of clean and sustainable energy policy decisions.
Federal Environmental and Energy Law
I work with clients to advocate for permitting and related decisions under federal law that protect natural resources and promote climate and ecological resilience. I represent clients in legal challenges to federal agency actions that fail to comply with the National Environmental Policy Act, the Clean Water Act, the Endangered Species Act, Transportation Act, laws governing energy generation and transport, and related laws.
Florida Public Records and Public Trust laws.
I advise and represent clients related to matters involving Florida’s public meetings and records laws, and those related to the ethical observations of public officials.
Constitutional Law issues, including property rights.
I am available to advise and represent public interest and governmental clients regarding constitutional rights and requirements, including federal and state of Florida property rights issues, as well as First Amendment rights related to public advocacy in the land use and environmental arenas.
